Terms and Conditions of Sale

We the company Tractus Services undertake to provide the service setup of website design and construction to you the customer/client on the following business terms:

a) On receipt  or placing of the initial order a deposit by cheque, cash or BACS to the sum of 50% of the initial quoted price is required plus VAT which is non-refundable. When constructed the site is put onto a  testing server so that the customer can view it before any final amendments. At this stage a further 30% is  payable to Tractus Services and the final 20% is payable after the final amendments and before the site  goes live.  Before training in the use of the control panel for eCommerce and CMS systems is carried out  the final balance is to be paid.  The customer will then have full access to the site to upload any information.

b) Any variance of work involving changes or additions to the initial requested work is to be reflected in the final pricing of the order invoice. This also applies to website updates. When the website is on the live server any amendments are chargeable at the normal hourly rate.

c) When an order is placed any images and text are to be provided by the customer to Tractus Services for the completion of the work. Tractus Services cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

d) Tractus Services cannot be held responsible for anything adversely affecting the client’s business operation, sales or profitability that might be claimed as a result of a service offered by Tractus Services Ltd.

e) Tractus Services Ltd will provide the customer with an expected completion date for the project and will make every effort to meet the deadline. We do not guarantee and are not bound in any way to complete the project by this date. The date provided by an employee of Tractus Services is purely an estimate.

f) When the customer has collated the information it can be sent by post or e-mail. In the case of local companies, if our sales staff have to collect the information there is no charge for the initial visit. Any subsequent visits are chargeable per visit as itemised on our price list.

g) Once the work is completed final payment is due before the work is passed to the customer. The work is the property of the company until the final payment is made.

h) Whilst every endeavour will be made to ensure that the website and any scripts or programs are free of errors, Tractus Services cannot accept responsibility for any losses incurred due to malfunction, the web site or any part of it.

i) The company provides information for the setting up of e-mails. It is not the responsibility of the company to set up e-mails on a customer’s computer. If this is required by the customer it is an extra charge at the normal hourly rate.

j) It is the responsibility of the Client to renew their domain names when due. If a domain name expires, Tractus Services Ltd can not be held liable for this. However, Tractus Services will make a reasonable effort to contact the Client regarding domain renewal.

k) When a Client renews Hosting with Tractus Services Ltd , this also includes domain renewal if the renewal is needed to keep the site functioning and was purchased as part of the Hosting package. If the Client does not renew the Hosting, their domain name could be made available to the public for purchase and Tractus Services Ltd can not be held liable for this.

l) Renewal of hosting is due on a yearly or biannual basis. The date of renewal will be annual or biannual from the date the web hosting was paid initially by the client. The hosting will not be renewed if Tractus Services Ltd cannot contact the client or the client requests for Tractus Services Ltd to not host this site.

m) The Hosting renewal charge must be received within 10 days of the Hosting expiry date. Tractus Services Ltd reserve the right to deactivate any website where the Hosting has expired and the Client has not paid the renewal charge. There will be an admin fee set by Tractus Services Ltd for transfering or reactivating the website/Hosting where appropriate.

n) In the event of non-payment of the balance of the service costs as agreed between the company and the client/customer being made, the whole of the balance outstanding will be required to be paid in cash on demand within a specified period. We the company reserve the right to recover balances of monies owed to us according to each case in question in any matter of default.

o) Acceptance of the quotation includes the acceptance of the terms and conditions of sale.
